What is Chapter 7 Bankruptcy?

Chapter 7 bankruptcy is a special set of laws from the U.S. government that protects people who are unable to pay their debts. For most people, the chapter 7 bankruptcy process takes about three months. The person (the “Debtor”) is protected from creditor harassment during the entire time. At the end, the Debtor gets an order from the bankruptcy judge called a “discharge order.” That discharge order means that all debts that can be wiped out have been wiped out. What is Chapter 13 Bankruptcy?

Chapter 13 bankruptcy is a less common but very powerful type of bankruptcy case. Unlike the very quick chapter 7 bankruptcy, chapter 13 bankruptcy lasts from 36 months to 60 months (three to five years). During that time, the Debtor makes a monthly payment that is used to pay off some of the debts owed by the Debtor. At the beginning of a chapter 13 bankruptcy case, the Debtors and their attorney propose a repayment plan to the bankruptcy judge. If the plan complies with all the bankruptcy rules, the bankruptcy judge “confirms” the plan. This means that the Debtors can hold onto their property, make a monthly bankruptcy payment for the required amount of time and then get a discharge of unpaid debts at the end of the case.
